PUBLIC NOTICE OF AMENDED VERIFIED COMPLAINT AND ORDER TO SHOW CAUSE HEARING PERTAINING TO BLOCK 2501, LOT 1.03 (233 FRANKLIN AVENUE) AND BLOCK 2501, LOT 2 (580 BELLEVILLE AVENUE) ON THE OFFICIAL TAX MAPS OF THE TOWNSHIP OF BELLEVILLE, COUNTY OF ESSEX, STATE OF NEW JERSEY 

PLEASE TAKE NOTICE that on April 6, 2026, an Amended Verified Complaint was filed with the Superior Court of New Jersey, Essex County, Law Division, under Docket No. ESX-L-1228-24, for the purpose of acquiring properties known as 233 Franklin Avenue, Belleville, New Jersey 07109, which is identified on the Official Tax Maps of the Township of Belleville as Block 2501, Lot 2, for public use.

PLEASE TAKE FURTHER NOTICE that the Court has issued an ORDER TO SHOW CAUSE requiring all Defendants, property owners and/or interested parties to appear and show cause before the Court as to why final judgment should not be entered that the plaintiff has duly exercised its power of eminent domain and further, why judgment should not be rendered appointing three disinterested commissioners, residents of the said County of Essex, to fix the compensation to be paid for the taking of property interests described in the complaint and such other relief as requested in the Plaintiff’s pleadings.

PLEASE TAKE FURTHER NOTICE that the Court has set a HEARING for Friday, August 28, 2026, at 1:30 pm (Eastern Standard Time), before the Honorable Richard Nunes, J.S.C. at the Superior Court at Essex County Courthouse 470 Dr. Martin Luther King, Jr., Blvd. - Floor 3, Newark, New Jersey 07102.

PLEASE TAKE FURTHER NOTICE that any Defendant, property owner and/or interested party must file and serve a written response to the Order to Show Cause by not later than three (3) days before the return date. The original documents must be filed with the Clerk of the Superior Court in Essex County via E-Courts on NJCourts.gov. You must send a courtesy copy of your opposition papers to the chambers of the Honorable Richard Nunes, J.S.C. at the Superior Court at Essex County Courthouse 470 Dr. Martin Luther King, Jr., Blvd. -Floor 3, Newark, New Jersey 07102. You must also send a copy of your opposition papers to the Plaintiff's attorney: Inglesino Taylor -Attn: James L. Esposito, Esquire, 600 Parsippany Road, Suite 204, Parsippany, New Jersey 07054. A telephone call will not protect your rights; you must file your opposition and pay the required fee, if applicable, and serve your opposition on your adversary, if you want the Court to hear your opposition to the relief the Plaintiff is seeking. Defendants are hereby notified that should they fail to so respond, judgment by default may be entered against such defendant for the relief demanded in the complaint.
